Terms and Conditions for Purchasing Tours in Jerusalem – Uri Lichtman

General

  1. The purchase of tours through the website is subject to the provisions of these Terms and Conditions. 
  2. The prices on the website include VAT. 
  3. The website owner is entitled to update the prices of the products and/or services from time to time, without prior notice. The updated prices shall appear on the website. 
  4. The purchaser declares that they are purchasing the website’s services for personal and non-commercial use. Resale of the services and/or the marketing thereof is strictly prohibited. 
  5. Furthermore, any other commercial and/or marketing use of the products is prohibited, unless prior written approval has been obtained from the website owner. 
  6. Inquiries to the website owner regarding various matters, customer service, questions, and clarifications shall be facilitated by contacting the email address: ori@jlmbyheart.com 

Purchasing a Tour: 

  1. Purchase on the website is executed by leaving details in the tour coordination form, after which the website owner will establish contact for coordination and purchase. 
  2. Booking a date for a tour/guiding is contingent upon the payment of a down payment in the amount of 10% of the transaction value. In the event of cancellation, no refund shall be granted for the down payment. 
  3. The website owner is entitled to change, add, or subtract payment methods and/or means of payment for any reason whatsoever and without prior notice. 
  4. The user declares that they are the legal owner of the payment method, or that they have received authorization to use the card or the payment method from its owner. 
  5. The user undertakes to enter current and accurate details. 
  6. The website owner reserves the right to terminate the website’s activity or the digital coordination services at any time, subject to a 30-day prior notice. 
  7. It is hereby clarified that the termination of the website’s activity as a platform shall not derogate from the rights of purchasers who have paid for a tour that has not yet taken place; in such a case, the service shall be provided as scheduled or the purchaser shall be refunded the full amount of their money. 
  8. The user is aware that given the scope of the website’s activity, a clerical error may occur in the price of the product or its description. In cases where the website owner deems that the discrepancy stems from good faith, the website owner shall be entitled to cancel the order and refund the purchaser’s money. 
  9. The publication of the service on the website does not constitute an offer. The placing of an order by the purchaser constitutes an offer to purchase, and the website owner is entitled to accept the offer and/or reject it at her sole discretion. 
  10. For payments made on a Net +30 basis or greater, an additional charge of 10% shall be levied for the cost of the tastings. 
  11. Liability and Safety 
  1.  Participation in the tour is contingent upon the participant being medically fit for the tour route as described on the website. It is the participant’s responsibility to update the guide regarding any relevant physical or medical limitation prior to the commencement of the tour. 
  2. The participants undertake to comply with the guide’s instructions throughout the entire duration of the tour and to exercise the required caution dictated by the road conditions. 
  3. The website owner/the guide shall not bear any liability for any bodily injury or property damage (including loss or theft of personal equipment) incurred by a participant during the tour.
  4.  In outdoor tours, the website owner is entitled to alter the tour route or cancel it due to extreme weather conditions, security directives, or force majeure. In the event of a cancellation by the website owner, participants shall be offered an alternative date or a full monetary refund. 
  • Costs and Conditions for Booking a Tour/Guiding 
  • Tour planning and guiding at a cost of 2,050 ILS. One menu must be selected out of the three presented for the culinary tour: 
  • Basic menu at a cost of 85 ILS per person. 
  • Expanded menu at a cost of 120 ILS per person. 
  • Premium menu at a cost of 160 ILS per person. 
  1. A tasting tour is equivalent to a full dinner. Its price shall be charged in accordance with the number of participants, which shall be updated approximately three months prior to the date of the tour __________ 
  2. Changes or adjustments to the menu may be made subject to prior coordination. 

Cancellation and Refund Policy: 

  1. The provisions of law shall apply to the cancellation of a transaction made through the website, and to the extent that there is a contradiction between the provisions of these Terms and Conditions and the applicable law, the provisions of the law shall prevail. 
  2. Cancellation of a transaction – within 14 days from the execution of the transaction or from the date of receipt of the contract/disclosure form, whichever is later, whether the provision of the service has commenced or not. Provided that the notice was delivered at least 7 days (which are not a Sabbath or a holiday) prior to the date scheduled for the provision of the service. 
  3. For a purchaser who is a person with disabilities, a senior citizen, or a new immigrant, the provisions of Section 14C1 of the Consumer Protection Law shall apply, and they shall be entitled to cancel the transaction within four months from the date of execution of the agreement, or from the day of receipt of the details specified in the regulations under Section 14(d), as the case may be, whichever is later, provided that the notice was delivered at least 7 days (which are not a Sabbath or a holiday) prior to the date scheduled for the provision of the service
  4. Notwithstanding the aforementioned, a purchaser is entitled to submit a request for the cancellation of a transaction under special circumstances; such request must be directed to the website owner via the contact methods specified in these Terms and Conditions, and she shall consider them in accordance with the circumstances of the matter. 
  5. The website owner is entitled to charge a transaction cancellation fee pursuant to any law – at the rate of 5% of the purchase value or 100 ILS, whichever is lower. 
  6. Insofar as a right of cancellation exists, a notice regarding the cancellation of a transaction must be made by contacting the website owner at the email address: ori@jlmbyheart.com or via a designated link on the website.
